1. Introduction

Welcome to CyberCastor Pty Ltd ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, products, services, and online courses (collectively referred to as "Services"). By accessing or using our Services, you agree to comply with and be bound by these Terms.
If you do not agree with these Terms, please do not access or use our Services.

2. Services Provided

CyberCastor provides online cybersecurity awareness training to small and medium businesses (SMBs). Our Services include but are not limited to training modules, online courses, educational materials, and other related content designed to raise awareness about cybersecurity risks and best practices.

3. User Responsibilities

By using our Services, you agree to:
• Use the Services solely for their intended purpose of enhancing cybersecurity awareness within your business
• Ensure that all information you provide to us is accurate, current, and complete
• Comply with all applicable laws, rules, and regulations while using our Services

4. Limitation of Liability

CyberCastor's Services are intended for educational and informational purposes only. We are not a security service provider and do not guarantee the protection of your business or personal data against any cyber threats or attacks.
• No Responsibility for Fraud or Scams: Under no circumstances shall CyberCastor be held responsible for any scams, frauds, data breaches, financial losses, or other cybersecurity incidents that occur within your business, whether they are related to the content of our training courses.
• Training Only: Our Services consist solely of cybersecurity training and awareness programs. The implementation of the information and practices shared through our training is entirely your responsibility. CyberCastor does not guarantee that following our training materials will prevent any cybersecurity incidents or frauds.
CyberCastor does not accept responsibility for any losses or damages arising from the use of our Services or any decisions made based on the information provided in our training.

5. Intellectual Property

All content, materials, and resources provided through our Services, including training modules, videos, text, and graphics, are the property of CyberCastor or our licensors and are protected by copyright and intellectual property laws. You may use the materials for personal or business purposes within the scope of the Services provided but may not reproduce, distribute, or otherwise use the content without our express permission.

6. Payment and Subscription

By subscribing to or purchasing our Services, you agree to pay the applicable fees. Payment is processed through third-party payment gateways (such as PayPal or Stripe). You are responsible for providing accurate payment details and ensuring that any payments made are authorized.
We reserve the right to change the pricing and subscription terms for our Services at any time, with notice provided to you.

7. Account Creation and Security

In order to access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
If you believe your account has been compromised, you agree to notify us immediately.

8. Termination of Services

CyberCastor reserves the right to suspend or terminate access to our Services at any time, without prior notice, if you violate these Terms or engage in any conduct that we deem harmful to the Services, other users, or our business.

9. Privacy and Data Collection

Your use of our Services is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our Services, you consent to the collection and use of your personal information as described in our Privacy Policy.

10. No Warranties

CyberCastor makes no warranties, representations, or guarantees, express or implied, regarding the effectiveness or security of the training programs or any of the information provided in the courses. The Services are provided "as is," and we make no promises about the accuracy, reliability, or completeness of the content.

11. Indemnity

You agree to indemnify, defend, and hold harmless CyberCastor, its employees, affiliates, contractors, and partners from any and all claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or in connection with your use of our Services, your violation of these Terms, or your business’s failure to implement appropriate cybersecurity practices.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Australia.

13. Changes to Terms of Use

CyberCastor reserves the right to modify or update these Terms at any time. Any changes will be posted on this page, and the updated date will be indicated at the top of the document. We encourage you to review these Terms periodically.

14. Subscriptions & Minimum Term Clause

Subscriptions
By selecting the annual subscription option for any CyberCastor training package, your clinic agrees to a minimum subscription term of 2 years("Minimum Term").
Billing & Payments
Subscription fees are payable annually in advance via the payment method selected at checkout.
The first payment is processed immediately upon enrolment. Subsequent payments are automatically processed on each annual anniversary.
All prices are exclusive of GST, and 10% GST will be added at checkout.
Minimum Term Commitment
By commencing a subscription, your clinic commits to a 2 years minimum term.
Early termination does not relieve your clinic of the obligation to pay the remaining subscription fees for the Minimum Term.
After the Minimum Term, the subscription will continue on an annual basis unless cancelled with at least 30 days notice prior to the next renewal date.
Cancellation
Cancellation requests must be submitted in writing to support@cybercastor.com.au .
Cancellations during the Minimum Term will remain subject to the outstanding balance of subscription fees for the remainder of the term.
Refunds
Subscription fees are non-refundable, except as required by law.

15. License Duration & Access Expiry

For one-off annual purchases, course access is granted to all users under a clinic license for a fixed 12-month period beginning on the date of purchase. Any staff enrolled after the initial purchase will have their access aligned with the clinic’s license term and will not receive additional time beyond the original 12-month period.
